Right of Withdrawal

Consumers have a right of withdrawal of fourteen days. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside that person's trade, business or profession. Businesses have no right of withdrawal.

Because we offer both services (repair, inspection and diagnostic orders) and goods, you will find two separate sets of instructions below. The instructions that apply to your contract govern. If you have ordered both — for example a repair and, in addition, a replacement unit — the relevant instructions apply separately to each part of the contract.

A) Withdrawal from repair, inspection and diagnostic orders (services)

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day the contract was concluded.

To exercise your right of withdrawal, you must inform us (AIRBAG24 Airbagsysteme, Schönefelder Chaussee 73, 12524 Berlin, Germany, e-mail: info@airbag24.de, phone: +49 30 75655671, fax: +49 30 75655672) by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract. You may use the model withdrawal form set out below, although it is not mandatory.

You can also exercise your right of withdrawal online via the withdrawal form on this website. If you use this online option, we will communicate to you an acknowledgement of receipt on a durable medium without delay, including information on the content of the withdrawal declaration and the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient for you to send your notice of the exercise of the right of withdrawal before the withdrawal period expires.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (with the exception of supplementary costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without undue delay and, in any event, no later than fourteen days from the day on which we received notice of your withdrawal from this contract. For this repayment, we will use the same means of payment you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged fees as a result of this repayment.

If you have requested that the services should begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided by the time you inform us of the exercise of the right of withdrawal in relation to this contract, compared with the full scope of services provided for in the contract.

Premature expiry of the right of withdrawal

Your right of withdrawal in respect of a contract for the provision of services expires prematurely if we have fully performed the service and only began performance after you had expressly requested this and, at the same time, confirmed your knowledge that you would lose your right of withdrawal once the contract had been fully performed by us (Section 356(4) German Civil Code (BGB) — loss of the right of withdrawal once performance of the requested service has been completed).

We obtain this declaration from you expressly before you submit your order. As long as you have not made this declaration, we will only begin the repair, inspection or diagnosis after the withdrawal period has expired. Likewise, we may only claim compensation for value under the preceding paragraph if you expressly requested the early start.

B) Withdrawal from the delivery of goods

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party indicated by you, who is not the carrier, took possession of the goods. In the case of a contract relating to several goods ordered together in a single order and delivered separately, the withdrawal period is fourteen days from the day on which you or a third party indicated by you, who is not the carrier, took possession of the last goods.

To meet the withdrawal deadline, it is sufficient for you to send your notice of the exercise of the right of withdrawal before the withdrawal period expires.

Effects of withdrawal

You must send back the goods to us without undue delay and, in any event, no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired. You bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion and premature expiry of the right of withdrawal for goods

The right of withdrawal does not apply, or expires prematurely, to the following contracts:

Contracts for the supply of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive, or that are clearly personalised to the consumer's personal needs (Section 312g(2) No. 1 German Civil Code (BGB) — goods manufactured to customer specifications). This includes, in particular, crash sensors and airbag control units or replacement units that are coded to a specific vehicle before shipment on the basis of the vehicle identification number (VIN) you provide.
Contracts for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene if they were unsealed after delivery (Section 312g(2) No. 3 German Civil Code (BGB) — sealed goods excluded for health or hygiene reasons). This includes our simulators (seat occupancy mats), which are delivered in sealed protective packaging: the correct deployment of the passenger airbag — and therefore the protection of the life and health of the vehicle occupants — depends on their being in flawless condition, and once the seal has been removed, prior use in a vehicle can no longer be ruled out.

Additional information (not part of the statutory instructions on withdrawal)

Return of a unit sent in for repair after withdrawal

If you have withdrawn from a repair order and your unit is already with us, we will send it back to you once we have received your withdrawal. We bear the cost of this return shipment.

Voluntary reversal of inspection orders

Regardless of the statutory right of withdrawal, we offer a voluntary reversal of the contract under Section 3.3 of our General Terms and Conditions. For a diagnosis already carried out, an inspection fee of EUR 79.00 including VAT may apply. Your statutory rights remain unaffected by this.

Voluntary goodwill return (not a statutory withdrawal)

Even in cases where no statutory right of withdrawal exists (see above), Airbag24 voluntarily grants, without acknowledging any legal obligation, a right of return of 14 days from receipt of the goods, provided the sealed protective packaging is unopened and the goods are unused (for example, if the wrong item was ordered by mistake). Once the seal has been opened or the goods have been used, a goodwill return is excluded. In this case, the customer bears the direct cost of the return shipment. There is no legal entitlement to this goodwill arrangement; your statutory warranty rights for defects remain unaffected.
